We are taking your bid multiplied by however many acres are in each tract. Tract 1 has 231.4 acres, tract 2 has 80 acres, tract 3 has 160 acres. This land is selling by the acre price. 

ONLINE BIDDING: Online bidders will need to fill out the online bidding application form at least 24 hours prior to auction date in order to be approved online. You will need to scan this form and send back to us or drop off with Clay. You can find the form under the documents section on the lot. 

 

PROCEDURE: The Gage County farms will be offered in three tracts.  The auction will be conducted in a live auction format with online bidding available through bid.schaardtauction.com. Schaardt Auction Service is acting only as a 3rd party software provider for this auction. This will be a per acre bid, meaning your bid amount will be taken times the acre. 

 

DOWN PAYMENT: A non-refundable 10% down payment is required on the day of auction. The down payment may be made in the form of cashier's check, personal check or corporate check. The 10% down payment is to be payable to Stewart Title and held in escrow by Stewart Title until closing. This sale is not contingent upon financing. 

 

ACCEPTANCE OF BID PRICE: This will be an absolute auction with no reserve price. The successful bidder will be required to enter into a Purchase Agreement at the auction site immediately following the close of the auction. 

 

EVIDENCE OF TITLE: Seller shall provide an owner's title insurance policy in the amount of the purchase price. Title insurance will be split 50/50 between buyer and seller. Any lender's policy will be paid for by the buyer. 

 

DEED: Seller agrees to convey to buyer by warranty deed with title free and clear.

 

CLOSING:  The property can be closed any reasonable time after the auction, but must be closed no later than 30 days after the auction.

 

POSSESSION: Full possession will be given upon final settlement. 

 

REAL ESTATE TAXES: 2023 Taxes paid by seller. 

 

PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Seller disclaims any and all responsibility for Bidder's safety during any physical inspection of the property. 

 

ACREAGE: All acreage totals, dimensions, and proposed boundaries are approximate and have been estimated based on current legal description, FSA maps, and/or current county records.
