Property to be sold via an online Auction on November 30th, 2023.  Nearly a half acre corner lot in the Village of Sterling.  House is need of major repairs or demolition.  Mature fruit trees in the large back and side yards make this an ideal building site.  Entire property being sold in as is condition. PROCEDURE: The Johnson County property will be offered in 1 individual tract totaling .39 acres +/-.  The auction will be conducted in an online auction format with online bidding available through bid.schaardtauction.com. Schaardt Auction Service is acting only as a 3rd party software provider for this auction. 

DOWN PAYMENT: A non-refundable 10% down payment is required on the day of auction. The down payment may be made in the form of cashier's check, personal check or corporate check. The 10% down payment is to be payable to Stewart Title and held in escrow by Stewart Title until closing. This sale is not contingent upon financing. 

ACCEPTANCE OF BID PRICE: This will be an auction with reserve. This means the property will sell subject to seller's confirmation of the final bid price. If the seller accepts the final bid price, the successful bidder will be required to enter into a Purchase Agreement at the auction site immediately following the close of the auction. The purchaser will also be required to deposit their earnest money at the conclusion of the auction.

EVIDENCE OF TITLE: Seller shall provide an owner's title insurance policy in the amount of the purchase price. Title insurance will be split 50/50 between buyer and seller. Any lender's policy will be paid for by the buyer. 

DEED: Seller agrees to convey to buyer by warranty deed with title free and clear.

CLOSING:  The property can be closed any reasonable time after the auction, but must be closed no later than 30 days after the auction.

POSSESSION: Full possession will be given at closing.

REAL ESTATE TAXES: 2023 Taxes will be prorated at the day of closing. 

PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Seller disclaims any and all responsibility for Bidder's safety during any physical inspection of the property. 

ACREAGE: All acreage totals, dimensions, and proposed boundaries are approximate and have been estimated based on current legal description, FSA maps, and/or current county records. 

AGENCY: Burrows Tracts Real Estate and its representatives are agents of the Seller, all buyer’s will be unrepresented.
