This is an online-only auction featuring a large selection of brand-new equipment, attachments, and building materials, all selling absolute to the highest bidder.

Agreement to Terms
By registering and bidding in this auction, bidders agree to all terms and conditions set forth by Schaardt Auction Service.
Condition of Items
All items sell AS-IS, WHERE-IS, with all faults and flaws, with no warranties stated or implied. Items have not been tested unless specifically stated in the item description. Items may have cosmetic damage from shipping, including but not limited to scratches, paint chips, or cracks. While obvious mechanical issues may be noted if observed, not every function of every item is tested. Bidders are strongly encouraged to inspect and test items prior to bidding.
Inspection
All items are available for inspection prior to the auction. Items may be located at the auction company’s yard or at the seller’s location. Seller contact information is listed on each lot. It is the buyer’s sole responsibility to inspect items, determine condition, and bid accordingly.
Payment Terms
Invoices are due no later than Friday, February 20, 2026 by 5:00 PM.

Wire Transfer (additional $20 fee)
Credit Card accepted on invoices under $2,000 only (3.5% processing fee)
Any payment not received by the deadline will be assessed a $25 per day late fee. Cash payments over $10,000 will be reported per IRS requirements.
Nebraska sales tax of 5.5% will be added to all invoices. Any applicable city or county tax will also apply. Buyers claiming agricultural or resale exemption must submit a completed Nebraska Form 13 unless one is already on file. All sales are final with absolutely no refunds.
Pickup and Loading
Items located at the auction yard must be removed during scheduled pickup times unless prior arrangements are made.
Pickup Dates:
Wednesday, February 18 through Friday, February 20
Time: 9:00 AM – 4:30 PM
Loading assistance is available for items at the auction yard by scheduling loadout with Clay at 402-862-5903 or by arriving during pickup hours. Items not picked up will incur a $25 per day per item storage fee. Items not removed within 45 days will become property of the auction company with no refunds.
Items located offsite at the seller’s location must be removed within 10 days of the auction. Storage fees of $25 per day begin on day 10 and are payable directly to the seller. After 45 days, ownership reverts back to the seller with no refund or proceeds due to the buyer.
40-foot storage containers cannot be loaded until the week following the auction and are by appointment only.
Auction Closing
This auction features a staggered soft close. Any bid placed within the final two minutes of a lot will reset that lot’s timer to one minute. This will continue until no bids are placed during the final minute. Lots are staggered to close every two minutes. Grouped lots may close simultaneously and will extend if any lot in the group receives a bid.
Titles
A $25 title fee will be charged on all titled items. Titles will be mailed via certified mail within 21 days after items are paid for and picked up. No exceptions.
Non-Paying Bidders
Non-paying bidders will be permanently banned from all Schaardt Auction Service online and live auctions. If an item must be resold, the original buyer will be responsible for any loss in value. All legal fees and collection costs incurred by the auction company will be the responsibility of the buyer.
Catalog Discrepancies
Bidders are bidding on the item description, not the photograph. Descriptions are believed to be accurate but are not guaranteed. It is the buyer’s responsibility to determine condition and suitability. All sales are final with no refunds.
Internet Bidding Disclaimer
Schaardt Auction Service is providing internet-only bidding for this auction. SAS is not responsible for missed or failed bids due to technical issues. Bidders are encouraged to place maximum bids well in advance of closing. All sales are subject to final certification by SAS. SAS reserves the right to withdraw, re-catalog, extend, restart, or cancel the auction at its sole discretion.
Additional Terms
Schaardt Auction Service reserves the right to refuse bidding privileges for any reason, including prior nonpayment. Buyer agrees to comply with all stated terms and conditions and acknowledges that all court actions will take place in Pawnee County, Nebraska.

PAYMENT: Invoices are due by Friday, February 20 by 5:00 PM.
We accept CASH, CHECK, and WIRE TRANSFERS. We only accept CREDIT CARD on invoices less than $2,000 (3.5% additional fee). We also accept Wire Transfers ($20 additional fee). Any payment not received by Friday, February 20 at 5:00PM will be subject to a $25 late fee per day.
Any one person paying with cash over $10,000 will have the proper IRS payment filed.
Nebraska sales tax of 5.5% will be added to your invoice. If the item is located in a county or city with additional tax, that will be applied. If you are claiming an exemption from sales tax for Ag or Resale, please complete a Nebraska Form 13 unless the auction company has one on file. All sales are final. Absolutely no refunds. You are contractually obligated to pay your items. You will be liable for damages and expenses for collecting payment if legal means are needed.
LOADING: Items that are located at the our auction yard and need removed on the scheduled pickup days unless other arrangements have been made in advance. Please contact the seller to remove your items. Pickup will be Wednesday, February, 18-Friday, February 20 from 9 am-4:30 pm on those days. If items are located at our auction yard, loading is available by scheduling loadout with Clay at 402-862-5903 or simply show up during the pickup days. Items not picked up will be charged storage fees of $25 per day per item. Items not removed in 45 days from the auction will become ownership of the auction company with no refunds given to the buyer.
Items that are located offsite at the seller's location are to be removed in 10 days from the auction. Storage of $25 per day starts on the 10th day which is payable to the seller directly. At 45 days, the item will revert ownership back to the seller with no proceeds or refunds given to the buyer.
40' Storage Containers will not be able to be loaded until the week following the auction and are by appointment only.
STAGGERED CLOSING: Auction uses a soft close bidding feature to create a live auction atmosphere. Any bids placed within the last 2 minutes will reset the clock on that item to 1 minutes. This will continue until there are no bids placed inside the last the minute of the item. Four lots are spaced 2 minutes apart so all items will close over a period of time.
GROUPED LOTS: Similar items may be in group close. This means they will close at the same time and they will extend if any of those lots receive a bid.
INSPECTION: All items are available for inspection ahead of the auction. Items are either at the auction company’s premise or the seller’s location. Please contact the seller of that item to setup an appointment to view. The seller’s contact information is posted on each lot. It is 100% the buyers sole responsibility to inspect items, determine condition, and to bid accordingly.
NONPAYING BIDDERS: We will ban you from participating in any of our online & live auctions indefinitely. IF DON'T INTEND ON FOLLOWING THROUGH WITH YOUR PURCHASE, DO NOT BID. Also if we must resell the item, you will be liable for any difference in price if sold for less than original auction. If the auction company pursues legal action against the non-paying bidder, all legal expenses of the auction company will be paid for by the buyer.

1. Schaardt Auction Service (hereinafter referred to as SAS) is providing internet only bidding for this auction. Bidder acknowledges and understands that this service may or may not function correctly at any time, including the auction closing time. Under no circumstances shall Bidder have any kind of claim against SAS or anyone else if the internet service fails to work correctly before or during the auction closing time. SAS will not be responsible for any missed or failed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should place their maximum bids at least two hours prior to the auction closing time. SAS reserves the right to withdraw or re-catalog items in this auction. In the event of any software problem, mistake or other issue, SAS reserves the right to extend the closing times, change the extension time, stop, restart or cancel this auction at its sole discretion. Even though an item may display as "sold" on the internet, no sales are final until they are certified by SAS and Bidder receives an invoice. SAS reserves the right to cancel any or all sales and resell the items in whatever manner it chooses. All property shall be removed from the premises by the Bidder at her/his own risk and expense within the time period announced. ALL MERCHANDISE PURCHASED AT THIS AUCTION MUST BE REMOVED AT THE SCHEDULED PICKUP TIMES LISTED. NO EXCEPTIONS!
2. If a check accepted by SAS is returned for any reason, Bidder agrees that SAS may re-present it in person or electronically and collect the full amount of the check as well as a $50 charge. Any amount left unpaid shall accrue interest at the highest rate allowed under Nebraska state law. Unless exempted by law, the purchaser shall pay all applicable taxes. Bidder agrees to indemnify SAS against any claim if sales tax is not collected on Bidder's purchases. Bidder agrees to not stop payment on any check paid to SAS. Bidder further agrees that under no circumstances will he/she initiate a chargeback on his/her credit card. Title to the merchandise transfers to Bidder only when Bidder's payment is honored. If any lawsuit arises, you the buyer agree to all court cases will take place in the Pawnee County Court System. If the buyer shall lose, the buyer will pay all of the auctioneer’s lawyer and court costs.
3. SAS may refuse registration and bidding privileges to anyone for failure to pay previous auction invoices, failure to provide a valid credit card or any other reason. Bidder hereby agrees that SAS may share information about Bidder's non-payment of auction invoices or shipping charges with other parties and may pursue collection of balances due by any legal means. Bidder agrees to provide any identification SAS may request including but not limited to: driver's license & state ID card. Bidder agrees to comply with any stated additional terms or conditions associated with particular items.
4. Any/all Purchasers will be expected to rely upon his/her personal inspection or investigation of the property being offered at the Auction, or that of an approved party to Buyer, and not upon any representation of warranty or condition by the Seller or the Auction Company. Seller or Auction Company will, in NO WAY, be held responsible for any discrepancies, damage or loss of any property of the Buyer once the Auctioneer says SOLD.
5. By registering for this auction you agree to be added to SAS's email list. Each email we send has an easy unsubscribe link at the bottom of the email. Please do not report our emails as spam. You will also be added to phone text message marketing for upcoming auctions. You may opt out by replying “Stop” to those text messages.
